Q. Who Needs Live Scan?
A. A notary public cannot take an acknowledgment on a document that is incomplete. (California Government Code section 8205.) When presented with a document containing a signature to be notarized, the notary public should visually scan the document to determine if the document is complete. Blank spaces and blank lines should be examined to ensure information is not missing. Also, if a notary public has experience with a particular type of document, and knows what information should be stated in the document, and that information is missing or incomplete, the notary public must refuse to notarize the signature. (California Government Code section 8205(a)(2).) Live Scan Fingerprints are required to be submitted by Real Estate Licensees, Notaries, Vehicle salespersons, vehicle dealers, driving instructors, or any other vehicle industry related occupation licensed by DMV, Foster Parents, Stock Brokers, Teachers, Appraisers, Elder Care Givers, as well as anyone having contact with children or the elderly, Security Guards, etc.
Anyone applying for the first time to be licensed as a vehicle salesperson, dealer, driving instructor, manufacturer, transporter, dismantler, registration service, distributor, lessor-retailer, remanufacturer, or any other vehicle industry relating to an occupational license issued by DMV will be Live Scan fingerprinted. It also applies to first time applicants for an ambulance driver certificate.
What should the applicant do if DOJ sends DMV a “delayed” response?
DMV cannot release a license or permit until the applicant passes a background check from DOJ.
Q. What are the benefits of Live Scan?
A. Live Scan will avoid many of the problems associated with ink prints, such as smudging, smearing, and over or under inking. A major benefit of Live Scan is in processing speed since nearly all of those without criminal records are done within 72 hours and up to 30 days if there is a criminal record. Rolled ink prints (traditionally submitted on a fingerprint card) can take 10 to 12 days to process (plus mail time) and up to 60 days if there is a criminal record.
Can my Live Scan results from another agency be used or forwarded to DMV?
No, DMV cannot contact DOJ for a copy of the results sent to another agency, nor can we accept a copy from any other source. DMV must receive a communication directly from DOJ to process the application. In order to receive communications from DOJ, the applicant must report to a Live Scan station with the correct DMV form, DMV 8016, Request for Live Scan Service (Refer to question; What will the applicant need to do to be Live Scan fingerprinted?)
What is a acceptable Identification (ID)
The identification must contain a photo, physical description, signature, serial number, issue / expiry date, date of birth etc.
